With this User non-Agreement I'm afraid I'm about done here. Too bad, Livejournal had a pretty good run for most of... has it been 20 years? Update to follow, I'll see if I want to have a go at Dreamwidth or place my eggs in the Google Plus basket.

The "here's your user agreement, except it's not legally binding actually" is some bullshit. Serious multinationals translate their ToS and have them legally reviewed in significant target languages. Granted English-speakers are a minority, but if you wanted to keep them you pay the money for legal translation services.

Also, I am not pleased to be taken as "subject to Article 10.2 of the Federal Act of the Russian Federation No. 149-ФЗ if more than three thousand Internet users access the Blog (the Blog’s page) within 24 hours" since that could happen outside of my control and I have no idea what this Russian law says. Something something intellectual property enforcement.

Also, and this is the biggest eyebrow-raiser to me, "User who posted comments in Blog and User keeping such a Blog shall be jointly and severally liable in respect of such comments" wtf. That's claiming that I as the journal owner will be fully liable for comments made by some internet random: as I understand it, "jointly and severally" means if there's any libel or other legal harm, a plaintiff can collect full damages from me, and if I say the internet random was the one at fault, it's my job to sue the internet random and enforce a judgment.

Also, combine this with that they appear to be claiming I'm liable under Russian law for that internet random's actions on my journal: "User shall be liable for breaching the terms and conditions hereof, including the requirements to Registration and Content posting, as well as for violation of applicable laws committed by User, including the laws of the Russian Federation and the laws of User’s residence"

I suspect that's a try at extraterritoriality that won't stand up -- I actually suspect the entire "you have to agree to our shrinkwrap contract you can't read" effort may be shaky -- but I think this ToS does it for me.

The transfer to dreamwidth does turn out to be quite easy, and the separation of "people who should see my friends-locked posts" from "journals I want to read" is quite marvelous. I'm currently doing a slow taper of cross-posting things back to here, and reading a couple of lj communities that I'm sure won't move at this point.

I didn't read the user agreement (probably should have!) but I think if you don't leave your livejournal public then you don't really run the risk of anyone making a comment that could end up getting you sued. I have a hard time imagining a comment that would get any of us sued unless we had a really controversial blog say for political or celebrity gossip. On a different note, there are very few people I know anymore who use live journal and since part of my enjoyment over having an online blog is reading other I've thought about jumping ship too.

Fair point. It's not so much that I have a realistic worry about being bitten by these things, I'm just sick of it.

Yeah, I just went and wrote a script to delete all of my entries (but keep the account login so I can at least follow whether other people also go to Dreamwidth). DW migration is pretty easy, although I had such an old LJ style that you basically can't do that anymore, so I had to approximate.

Turns out LJ has a post rate limit though, so after deleting like 500 entries it basically said "lol stop spamming our server you're posting too frequently".

I'm not really a fan of Google+ for communicating either -- the main fact being that I can't change the security of a post after it's posted, is pretty much a deal-breaker for me.

I'm amazed and impressed that my archaic LJ style still works at all. They've done some things nicely.

Interesting, do you fairly often want to change the ACL on a post? In the "widening" direction (like private 'draft' post -> public), or the "narrowing"?

Also they can change the user agreement at any time without notice and you still agree to it.

Yeah, this is busted. I'm bound by an agreement I can't read? No, I think not. (If you disable Javascript from livejournal.net and use direct URLs you can read your friends page and comment, which is how I'm here. You can't post or use most site navigation, though.)

Bah. I had been stupidly hoping that everyone would see how horrible Facebook was and would come back to Livejournal. I wish I could tell everyone leaving that they're making a mistake. I have a Dreamwidth account, and they seem like a nice bunch.
